Dear Water User,
The Breede-Olifants Catchment Management Agency (BOCMA) cordially invites you to participate in a stakeholder engagement session regarding the Validation and Verification of Existing Lawful Water Use within the “K” Primary Catchment.
In accordance with Regulation 3(b) of Regulation 1352, dated 12 November 1999, and in terms of Section 21 of the National Water Act, 1998 (Act No. 36 of 1998), all persons using water must register their water use when instructed to do so by the responsible authority. The call for registration within the (then) Breede and Gouritz Water Management Areas (WMAs) was originally published under Notice 515, Government Gazette No. 21215 of 26 May 2000, with an extension to 30 June 2001 under Notice 334, Government Gazette No. 22201 of 6 April 2001.
BOCMA has initiated the validation and verification of all existing lawful water use (ELU) in accordance with the National Water Act. This statutory process serves to:
• Validate the accuracy of registered water use information, and
• Verify the lawfulness of that water use based on historical entitlement.
The process is essential to ensure sustainable and equitable allocation of water resources and to curb unlawful water use practices, including unauthorised abstraction, storage, or commercial afforestation. The continued prevalence of unlawful use undermines both existing and future authorisations.
This engagement will introduce stakeholders to the project objectives and focus on the technical framework and approach.
